動画・生配信・画像投稿・インタラクティブ配信利用に関するガイドライン

株式会社スクウェア・エニックス（以下「弊社」といいます）は、弊社の提供する『トルネコの大冒険 不思議のダンジョン　ちょっとステキなリマスター』（以下『本ゲーム』といいます）のプレイ動画の投稿、生放送配信、および画像投稿を、以下の【利用条件】および投稿・配信先のサイトが定める利用条件に従うことを条件として、【利用範囲】の範囲で行うことを認めます。

【 利用範囲 】

• 本ゲームのプレイ動画（ゲーム内のBGMを含みます。以下同じ）を非商用使用の目的で、「YouTube」「ニコニコ動画」等の一般社団法人日本音楽著作権協会（JASRAC）と音楽に関する利用許諾契約締結済の動画共有サイト（以下「許諾動画共有サイト」という）に配信すること。（この配信などにリンクすることを含みます）。
• 本ゲームのプレイ画像 及び前記の配信動画のURLやサムネイルを非商用使用の目的で、個人（法人は含まれません）のブログやX（旧：ツイッター）などのミニブログで利用すること。
• 配信者または視聴者としてインタラクティブ配信機能を利用すること。

【 利用条件 】

• 画像・動画（以下「動画等」といいます）の掲載・配信に際して、以下の著作権表記をしてください。

• ゲームシナリオに大きく関わるシーンを配信する場合には、これからプレイされる方の楽しみを奪わないよう、自主的に「ネタバレあり」の表記をお願いいたします。
• 通常のゲームプレイを意図せず、ムービーシーン（イベントシーンを含む。以下同じ）のみを見せることや音楽のみを聴かせることを目的として作成・編集された動画等の投稿や再生リストの作成は禁止いたします。
  禁止動画等の例）
  ・ムービーシーンのみ、または大部分がムービーシーンからなるもの
  ・プレイヤブルなキャラクターを静止させたままにする、単純な操作のみを繰り返すなど通常のプレイ進行を伴わない状態で、楽曲を継続して視聴可能とするもの
  ・ムービーシーンの画像を連続で大量に掲載し、ムービーシーンのみを見せようとするもの
• 動画等の改変は行わないでください。ただし、動画等に字幕、ご自身のアバター・声を重ねるなど、ゲーム実況やプレイ動画の配信に一般的に必要とされる加工・改変を行うことは認めます。
• 公開した動画等の二次利用は行わないでください。
  例）有料・無料を問わず、公開した内容をまとめて冊子などの別の媒体での再配布すること。
• 閲覧に対価が必要となるサイトおよびサービスを利用しての動画等の公開は行わないでださい。
  （但し、ニコニコ動画プレミアムサービスを除く）
• 許諾動画サイトが正式に提供する投稿者向けの収益化機能を使用する場合を除き、動画等を商用・営利目的に使用しないでください。動画等を収益化機能に使用することについて、許諾動画共有サイト側から照会があった場合、本ガイドラインをご案内ください。なお、弊社は動画等に関する個別のお問い合わせは受け付けておりません。
• 以下に該当するサイトを利用して動画等の公開を行わないでください。
  ・18才以上のみを閲覧対象としたサイト
  ・公序良俗に反するサイト
  ・宗教活動や政治活動、反社会的活動に関連するサイト
• 特定のユーザーの誹謗中傷につながる行為は行わないでください。
• 配信者または視聴者に対するいやがらせや迷惑行為等を行わないでください。
• 弊社から依頼があった場合には、遅滞なく動画等の掲載を中止してください。 また、弊社が不適切と判断した生放送・ 動画等については、削除させていただく場合があります。
• 自分以外のユーザーの名前が表示されている動画等を配信する場合は、予め本人の承諾を得てください。もし承諾を得ることができない場合は、該当する名前部分にモザイク処理等の加工を行ってください。
• 他のユーザーのIDが表示される場所を動画等で公開しないでください。
• 動画等において自身のID、その他の情報を公開する場合は、自らの責任のもとで行ってください。
• ユーザーは、本ガイドラインに従った動画等の利用を自らの責任で行うものとします。弊社は、本ガイドラインに従った動画等の利用が第三者の権利を侵害していないことを含め、本ガイドラインに従った動画等の利用についていかなる保証もいたしません。また、動画等を利用された結果発生したいかなる損害についても補償いたしません。
• ユーザーは、動画等を利用された結果発生した他のユーザーを含む第三者との紛争を自らの責任と費用で解決するものとします。
• ユーザーが本ガイドラインに違反した場合、弊社は当該ユーザーの本ゲームの利用に関して、一時利用停止処分または永久利用停止処分を行う場合があります。
• 弊社は弊社の裁量によりいつでも本ガイドラインの内容を変更することができます。ガイドラインの更新前に投稿、配信、掲載された動画等が更新後のガイドラインに定める条件を満たさない場合、当該動画等を削除させていただく場合があります。
• インタラクティブ配信機能はβ版となります。本サービスは予告なく変更または終了する場合があり、その際は利用できなくなる可能性がございますので、あらかじめご了承ください。

『トルネコの大冒険 不思議のダンジョン　ちょっとステキなリマスター』
配信用キット利用に関するガイドライン

株式会社スクウェア・エニックス（以下「当社」といいます）は、当社のゲームソフト「トルネコの大冒険 不思議のダンジョン　ちょっとステキなリマスター の公式サイト」にてご提供する「トルネコの大冒険 不思議のダンジョン　ちょっとステキなリマスター」配信用キット（以下「本キット」といいます）の利用を以下に定める規約（以下「本利用規約」といいます）に従って許諾します。

1. 当社は、本キットをご利用になる皆様（以下「利用者」といいます）が本利用規約を承諾し、本利用規約に定める条項を遵守することを条件として、本キットを、利用者個人（ゲームプレイの配信を行うことで法人から給与その他の報酬を得ている方を含みます）のゲーム配信・動画投稿及び個人名義のソーシャル・ネットワーキング・サービスなどで使用することを許諾するものとします。なお、当社は、本キットの権利者として、利用者が本利用規約に反する本キットの利用を行ったと当社が判断した場合については、本キットの利用を中止するよう要請する場合や、当社が本キットを削除する場合があります。本キットを利用する場合は、本利用規約をよくお読みになり、すべてに同意された上で行ってください。実際に本キットを利用された場合、本利用規約に同意されたものと看做します。なお、未成年の方は、本利用規約について、保護者等の法定代理人の同意を得た上で利用してください。
2. 本キットは、非営利・非商用の目的にのみご利用いただくことができます。
3. 本キットをインターネット上で利用する場合、著作権者の表示と再利用を禁止する事項を公開する場所の分かりやすい場所に明記してください。なお、個人名義のソーシャル・ネットワーキング・サービスについては、著作権者の表示と再利用を禁止する事項の掲載を免除いたします。

4. 本キットに係る著作権その他一切の知的財産権は当社に帰属するものとします。
5. 本キットの利用にあたっては、以下の行為を禁止するものとします。
   • 過度な編集または改変した本キットの利用
   • 本キットのイメージを損なう利用
   • 当社その他の第三者の所有権、知的財産権、名誉、信用、プライバシー等の権利を侵害する利用
   • 犯罪またはこれに類すると判断される可能性のある利用
   • 当社または第三者への誹謗・中傷・攻撃を目的とした利用
   • 公序良俗に反する利用
   • 個人情報または個人を特定できる情報を掲載する行為
   • 商業活動・営業行為・布教活動を目的とした行為
   • 反社会的・反道徳的で周囲に悪影響を及ぼす恐れのある行為
   • 当社に不利益をもたらす行為
   • その他、当社が不適切と判断した利用
6. 本キットは現状有姿にて無償で提供されるものであり、エラー・バグ等の不具合を含み得るものとして、当社から提供されます。従って、当社は、利用者及び他者に対し、本キットについて、その正確性・完全性・有用性・信頼性等に関していかなる保証もいたしません。
7. ユーザーは、本利用規約に従った本キットの利用を自らの責任で行うものとします。当社は、本利用規約に従った利用が第三者の権利を侵害していないことを含め、本利用規約に従った動画等本キットの利用についていかなる保証もいたしません。また、本キットを利用された結果、利用者又は他者に発生したいかなる不利益、損害（本キット以外のソフトウェア、データ又はハードウェア等に生じた損害等を含みますがこれに限りません）について一切の責任を負わないものとし、補償をいたしません。
8. ユーザーは、本キットを利用された結果発生した他のユーザーを含む第三者との紛争を自らの責任と費用で解決するものとします。
9. 利用者が本利用規約のいずれかの条項に違反した場合又は当社の著作権その他の知的所有権を侵害した場合には、当社は、何らの通知を要することなく、本利用規約に基づく使用許諾契約を解除できるものとします。
10. 当社は、本利用規約を事前の予告なく任意に変更できるものとします。その場合、当社は最新の本利用規約を本サイトに掲載するものとし、本サイトに掲載された時点で変更の効力が発生するものとします。
11. 本利用規約は、成立、効力、解釈及び履行を含め、全ての事項について日本国法令に従うものとし、本利用規約に関連する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Materials Usage Guidelines

Square Enix Co., Ltd. (“SQUARE ENIX”) permits its fans to share certain images ("Images") and gameplay videos ("Videos")(collectively "Materials") of Dragon Quest Heroes: Torneko's Mystery Dungeon -Classic HD- (“Game”) online so long as these Guidelines are adhered to. SQUARE ENIX reserves the right to object to any use of the Materials and may submit takedown requests to third parties hosting any such content. With that said, here are some general rules that will guide our decisions:

[Permitted Usage]
The permitted use of the Images and Videos are as follows:

• Sharing the Videos (including those containing background music) for non-commercial purposes on video-sharing sites such as YouTube, Twitch, Facebook, TikTok and Instagram. You can’t require payment to view or access any Materials. However, SQUARE ENIX does allow you to monetise content via advertising through platform-operated programs on YouTube, Twitch, and other similar services.
• Sharing the Images and URL of the Videos for non-commercial purposes on your personal homepages, blogs, social networking services is permitted. Sharing the Images and URL of the Videos on any homepages, blogs, social networking services owned by a corporation or any type of organization (and not an individual) will be regarded as commercial use and is not permitted.
• Using the interactive streaming feature as a streamer or viewer.

• SQUARE ENIX asks that you please display the following proprietary notices on Images or Videos (collectively, the “Materials”) and any other content that incorporates the Materials:

  NOTE: This proprietary notice might already be added automatically when sharing Videos and Images using certain consoles' built-in sharing functions. If so, it is not necessary to add the propriatery notice manually.
  NOTE: It is not necessary to include the proprietary notice when posting the Materials to microblogging platforms (such as X (formerly Twitter)).
• No spoilers please. In order not to spoil other players’ enjoyment, you must mark all content that includes details of major plot developments with a clear spoiler warning.
• You are not permitted to create edited video content or playlists with the goal of showing only cinematic scenes (as opposed to gameplay), or only listening musics, from the Game.
• You may not alter or modify the Materials, except:
  You may add your own avatars, voice-over, texts, and other generally required in sharing the Materials.
• Do not reproduce shared Materials other than as expressly contemplated by these Guidelines. For example, you must not collect and distribute Materials via other media - e.g., in book form.
• Do not share Materials on paid sites or services.
• Do not use Materials for commercial use, except as part of the partner programs operated by YouTube, Twitch, or similar programs.
  If the operator of the partner program seeks to confirm our policy, please point them to these Guidelines. Please note that SQUARE ENIX does not address individual requests.
• Do not share Materials on the following sites or services:
  ・Sites or services intended only for those aged 18 and over
  ・illegal or immoral sites or services
  ・Sites or services that are religious, political, or related to antisocial activities
• Please refrain from slandering specific players.
• Please do not harass or disturb streamers or viewers.
• You must immediately comply with any request from SQUARE ENIX to remove Materials from any platform, regardless of whether SQUARE ENIX provides a reason for the request. SQUARE ENIX reserves the right to require or seek removal of any content incorporating the Materials that it deems to be inappropriate at its sole discretion.
• If you wish to share Materials which shows other players' names or other identifying information, you must obtain the players' consent. If you can't obtain consent from any of the players, you must conceal the information of the non-consenting players with mosaic or other means.
• Do not share parts of the Game that show other players ID, name, or other identifying information.
• If you elect to share your ID or personal information, you do so at your own risk.
• SQUARE ENIX makes no representation and/or guarantee concerning the Materials, including that the Materials do not infringe third party rights. SQUARE ENIX shall not be responsible and assumes no liability to you or any third party for any damages or injuries that arise from your use of the Materials.
• You must settle disputes with third parties (including other users of the Site or the Services) arising as a result of your use of the Materials, at your own responsibility and expense.
• If you do not adhere to these Guidelines, SQUARE ENIX may, in addition to objecting to your use of the Materials, temporarily or permanently suspend your use of or access to the Game.
• SQUARE ENIX may modify these Guidelines at its sole discretion, at any time and without prior notice. You may be asked to remove any Materials that no longer comply with the updated Guidelines.
• The interactive streaming feature is currently in beta. Please note that this service is subject to change or termination without prior notice, and may become unavailable in such cases.

Guidelines Regarding the Use of the Streaming Kit for
Dragon Quest Heroes: Torneko's Mystery Dungeon -Classic HD-.

Square Enix Holdings Co., Ltd. (hereinafter referred to as the "Company") grants permission for the use of the streaming kit for Dragon Quest Heroes: Torneko's Mystery Dungeon -Classic HD- (hereinafter referred to as the "Kit") provided on our Dragon Quest Heroes: Torneko's Mystery Dungeon -Classic HD- website (hereinafter referred to as the "Site") in accordance with the agreement established below (hereinafter referred to as the "Terms").

1. The Company shall grant permission for use of the Kit to users (hereinafter referred to as "User(s)") for live game streaming, posting videos, and use on their personal social networking accounts, provided that such Users agree to the Terms and observe all stipulations laid out within. This includes individuals who receive a salary from a corporation or other forms of compensation for streaming gameplay. Note that the Company, as the rights holder of the Kit, may request the cessation of the use of the Kit or may delete the Kit if the Company determines that a User has violated the Terms in using it. Please read the Terms carefully and agree to them in their entirety before using the Kit. Use of the Kit is considered an acknowledgement that you have agreed to the Terms. Furthermore, in accordance with the Terms, minors must obtain the consent of a legal representative, such as their guardian, before using the Kit.
2. The Kit may only be used for non-profit and non-commercial purposes.
3. If you use the Kit on the Internet, please clearly state the notice of copyright and the prohibition of reuse in an easy-to-find location on the site where you use it. Please note that personal social networking accounts are exempt from the requirements to display the notice of copyright and the prohibition of reuse.

4. All copyrights and other intellectual property rights related to the Kit belong to the Company.
5. The following actions are prohibited when using the Kit:
   
   • Use after excessive editing or modification of the Kit
   • Use that undermines the image of the Kit
   • Use that infringes on the Company or a third party, including, but not limited to, their ownership rights, intellectual property rights, integrity, reputation, or privacy
   • Use that constitutes a criminal act or that may be deemed to be equivalent to a criminal act
   • Use for the purpose of slander, libel, or criticism of the Company or a third party
   • Use that violates public policy
   • Publication of personal information or information that can be used to identify an individual
   • Use for the purpose of commercial activity, business activity, or proselytizing
   • Offensive or immoral acts that may have a negative impact on those around you
   • Acts that result in a loss for the Company
   • Other uses that the Company deems inappropriate
6. The Kit is being made available by the Company in its present state free of charge, and it may contain flaws such as errors or bugs. Accordingly, the Company makes no guarantees to the Users or other parties regarding such things as the accuracy, completeness, usefulness, or reliability of the Kit.
7. Users shall accept full responsibility for their own use of the Kit in accordance with the Terms. The Company makes no guarantees regarding the use of the Kit according to the Terms, including that its use will not infringe on the rights of third parties. Additionally, the Company will assume no responsibility nor provide any compensation for any loss or damage (including, but not limited to, damage to software, data, or hardware apart from the Kit) as a result of the use of the Kit.
8. Users shall accept full responsibility for, and resolve at their own expense, any disputes that arise with any third parties, including other Users, as a result of their own use of the Kit.
9. The Company may, without any kind of notice, terminate the license agreement under the Terms if a User violates any part of these Terms or infringes on the Company's copyrights or other intellectual property rights.
10. The Company may revise the Terms without prior notice. In such cases, the Company shall publish the newest version of the Terms on the Site, and the changes shall be effective upon such publication.
11. All aspects of the Terms, including their establishment, validity, interpretation, and execution, shall be governed by the laws of Japan, and any disputes that occur in relation to the Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
